River City Pools Terms of Service
These Terms of Service (“Terms”) govern residential pool services provided by River City Pools, Inc. (“River City Pools,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). These Terms apply to residential pool maintenance and other residential pool services purchased from or provided by River City Pools.
By requesting, purchasing, or receiving services from River City Pools, you acknowledge and agree to these Terms, along with any applicable estimate, proposal, service plan, or other written agreement provided for your service. If a written agreement contains terms that differ from these Terms, the terms of the written agreement will control for that service.

Our commitment to Our Customers – Weekly Services Provided:

As part of your routine weekly pool service, River City Pools, Inc. will provide the following services, as applicable to your service plan:

Checking and emptying skimmer and pump basket as needed.

Test and balance pool water chemistry within appropriate operating ranges.

Supplying routine chemicals including chlorine (liquid and/or tablet), salt, muriatic acid, sodium bicarbonate, and cyanuric acid

Brushing your pool walls and floor.

Vacuum pool floor as needed.

Skim the pool surface to remove leaves, debris, and other floating material as needed.

Inspect pool equipment for visible signs of leaks, damage, or improper operation.

Clean or backwash the pool filter approximately every four weeks, or as needed based on filter type and pool conditions.

Inspect and clean the salt cell approximately every eight weeks, as needed, for pools equipped with a salt-chlorine generation system.

Provide a service report following each completed scheduled service visit, including photographs documenting applicable services performed, such as filter service, salt cell service, and overall pool condition and cleanliness.

Customer responsibilities – our ask of you:

To ensure safe and efficient pool service, customers are responsible for the following:

Ensure our technicians have safe and unobstructed access to the pool and equipment area on the scheduled service day, including clear access for service equipment and vacuum carts.

Secure all pets away from the pool, equipment, and service access areas before the technician arrives and throughout the service visit.

Remove pool toys, floats, floating mats, and non-automatic pool covers from the pool before the scheduled service visit.

Please ensure the water level of your pool is maintained at the correct level – about halfway up the skimmer. Our technicians do not have adequate time allotted during weekly service visits to drain or re-fill the pool. If you require this service, please contact the office to arrange a separate service call.

By providing your phone number, you agree that River City Pools, Inc. may contact you by call or text message regarding scheduled service, appointment notifications, service-related matters, estimates, billing, and other communications related to your account. Message and data rates may apply.

Billing information:

Invoices are issued on the first day of each month and payment is due no later than the 15th of that month. A $25 late fee will be applied to payments received after the due date. Customers paying by mail are responsible for allowing sufficient time for payment to be received by the due date.

The monthly service rate is based on routine maintenance of a generally clean and serviceable pool under normal conditions. Excessive debris, storm-related cleanup, unusual pool conditions, or cleaning and corrective services beyond the scope of routine weekly maintenance may result in additional charges.

Weekly service is billed on the basis of 48 scheduled service visits per year, with the annual service cost divided into 12 equal monthly payments. Monthly rates therefore remain consistent regardless of the number of scheduled service visits occurring in a particular month. River City Pools, Inc. does not provide routine weekly service during the week of Thanksgiving or the week between Christmas and New Year ’s. The 48-visit annual service schedule also allows for service interruptions caused by severe weather, holidays, or other unavoidable circumstances.

Minor repair or replacement items costing $50 or less may be replaced as needed without prior customer approval and will be added to the customer’s invoice. Examples include O-rings, pump baskets, skimmer baskets, pressure gauges, air-relief valves, and similar minor components.

If River City Pools, Inc. is required to pursue collection of an unpaid balance, the customer will be responsible for reasonable costs associated with collection, to the extent permitted by applicable law. A $75 administrative fee may also be assessed to the customer’s account for accounts requiring formal collection action.

Customers are required to maintain a valid payment method on file as a condition of residential weekly service. If payment for the agreed-upon monthly service rate is not received by the 15th of the month, River City Pools, Inc. is authorized, pursuant to the customer's payment authorization, to charge the payment method on file for the outstanding monthly service balance. Service may be suspended or terminated for unpaid accounts.

Credit card payments are subject to a 3% processing surcharge, which is calculated and applied by the payment processor in accordance with the payment authorization terms presented to the customer.

Additional information:

Equipment repairs or replacement are not included in routine weekly pool service unless specifically stated otherwise. If equipment problems are identified during service, River City Pools, Inc. may diagnose the issue and provide repair or replacement recommendations. Repairs exceeding the minor-repair authorization stated in these Terms will require customer approval before work is performed. Parts, materials, and labor for such repairs will be billed separately.

Inclement Weather: Scheduled service may be modified, delayed, or rescheduled when lightning, severe weather, or other unsafe conditions prevent service from being performed safely. When conditions permit, River City Pools, Inc. may perform available portions of the scheduled service, including water chemistry testing and treatment. Services that cannot be safely or reasonably performed due to weather conditions may be postponed until the next scheduled visit or completed at another time at the discretion of River City Pools, Inc.

Holiday Scheduling: Routine weekly service is scheduled in accordance with the 48-visit annual service schedule described in the Billing Information section. Service days may be adjusted when necessary due to holidays, scheduling requirements, or other circumstances. Customers will be notified when a significant change to their normal service schedule is necessary.

Service Questions or Concerns: Customers should promptly contact River City Pools, Inc. regarding questions, concerns, or problems related to pool service or equipment. Prompt notification allows us to evaluate the issue and determine the appropriate course of action.

Cancellation

Residential weekly pool service is provided on a month-to-month basis and does not require a long-term service contract.

Cancellation requests must be submitted in writing by email to service@rivercitypoolsinc.com or by text message to (904) 784-POOL (7665). Service will remain active until River City Pools, Inc. receives and processes the cancellation request.

If service is canceled during a billing period, any services provided during a partial month may be billed individually at the applicable one-time service rate, with a minimum charge of $75 per service visit.
